1. Agreement to Terms
By accessing or using the Femme Intelligence AI website and services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not access our services. These terms apply to all visitors, clients, and others who access or use our services.
2. Services
Femme Intelligence AI provides done-for-you AI workflow systems for mortgage brokers, real estate professionals, and service-based business owners. Services include but are not limited to: Speed-to-Lead automation, AI Deal Capture systems, AI Receptionist systems, and follow-up automation. The exact scope of services is defined in the individual service agreement or proposal provided to each client prior to engagement.
3. Payment Terms
All service fees are due as outlined in your individual service agreement. Setup fees are due prior to build commencement. Monthly retainer fees are billed on a recurring monthly basis. All invoices are payable within 7 days of issue unless otherwise agreed in writing.
4. No Refund Policy
All service fees paid to Femme Intelligence AI are non-refundable. This includes setup fees, monthly retainer fees, and any other fees charged in connection with our services. By engaging our services, you acknowledge and agree to this no-refund policy.
5. Client Responsibilities
Clients are responsible for: (a) providing accurate business information required to build their systems; (b) maintaining any required third-party subscriptions discussed prior to project commencement; (c) reviewing and approving all scripts, messaging, and automation sequences before launch; (d) ensuring all automated communications comply with applicable regulations in their jurisdiction; and (e) maintaining compliance with all industry-specific regulations applicable to their business, including but not limited to mortgage, real estate, and any applicable service industry regulations.
6. Compliance Disclaimer
Femme Intelligence AI builds automation systems based on client-approved scripts and messaging. We do not provide legal, compliance, or regulatory advice. Clients are solely responsible for ensuring their automated communications comply with all applicable laws and regulations, including but not limited to PIPEDA, CASL, TCPA, and any applicable mortgage industry regulations. We strongly recommend all scripts be reviewed by a compliance officer before deployment.
7. Intellectual Property
All systems, workflows, and automations built by Femme Intelligence AI are delivered to the client upon completion and payment in full. Clients own the systems built for them. Femme Intelligence AI retains the right to use general methodologies, frameworks, and approaches developed in the course of client work for future projects.
8. Cancellation
Monthly retainer agreements may be cancelled by either party with 30 days' written notice. Upon cancellation, all systems remain accessible to the client. Femme Intelligence AI will not delete or modify client systems upon cancellation. Setup fees are non-refundable regardless of cancellation timing.
9. Limitation of Liability
To the maximum extent permitted by law, Femme Intelligence AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profits, or loss of business, arising from or related to our services. Our total liability to any client shall not exceed the total fees paid by that client in the three months preceding the claim.
10. Third-Party Platforms
Our services may utilise third-party platforms and infrastructure. We are not responsible for outages, changes, or disruptions to third-party platforms. Clients are responsible for maintaining their own accounts and subscriptions with any required third-party providers.
11. Governing Law
These Terms & Conditions are governed by the laws of Canada. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in Canada.
12. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the updated terms.
